Privacy Policy / Datenschutzerklärung
Last updated: [FILL IN: date]. Information pursuant to Articles 13 and 14 GDPR and the Austrian Data Protection Act (DSG).
1. Controller
Rafael Bueno de Mesquita, address as listed in the Impressum. Email: rafael@aidiomusic.ai.
No Data Protection Officer is appointed because the legal threshold under Art. 37 GDPR is not met. For all data protection inquiries, contact the controller directly via the email above.
2. What we collect and why
Alpha application form. When you submit your email through the "Apply for Alpha" form, we store your email address solely to evaluate your application and to contact you about the closed alpha. Legal basis: Art. 6 (1) (b) GDPR (pre-contractual measures at your request) and Art. 6 (1) (f) GDPR (legitimate interest in selecting suitable testers).
Server log files. Our hosting provider automatically logs technical information when you visit this website: IP address (anonymised or truncated where possible), browser type, operating system, referrer URL, time of access. This data is used only for security, error diagnosis and statistical analysis in aggregated form. Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in a secure and stable website).
Email correspondence. If you write to us, we store your message and contact details to handle your request. Legal basis: Art. 6 (1) (b) and (f) GDPR.
3. What we do NOT collect
We do not run third-party analytics (no Google Analytics, no Facebook Pixel, no Hotjar). We do not embed social media trackers. The website does not profile visitors.
When you use the AIDIO plugin inside your DAW: your raw audio never leaves your computer. Audio analysis runs locally. Only anonymised numerical measurements (loudness, band energies, transient statistics) are sent to our AI proxy server to generate advice. The plugin license check transmits a hashed device fingerprint plus your license code, nothing else.
4. Cookies and local storage
This website sets one technical cookie (or localStorage entry) to remember your cookie consent choice. No tracking, advertising or analytics cookies are set.
The website loads typography from Google Fonts. When fonts are loaded directly from Google servers, your IP address is transmitted to Google. We are evaluating moving to self-hosted fonts to avoid this transfer. By rejecting non-essential cookies on the consent banner you also block Google Fonts; the site then falls back to system fonts. Legal basis with consent: Art. 6 (1) (a) GDPR.
5. Hosting and processors
The website is hosted by [FILL IN: hosting provider name, e.g. "Cloudflare Pages" or "Vercel"] at [FILL IN: provider address / country]. A data processing agreement per Art. 28 GDPR is in place where required.
The AIDIO AI proxy runs on Cloudflare Workers (Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA) with EU data residency where available. Cloudflare is a recipient of anonymised plugin telemetry described in section 3.
AI inference is provided by OpenAI L.L.C., 3180 18th Street, San Francisco, CA 94110, USA. OpenAI processes only the anonymised measurement payload and our system prompt. Audio is never sent. Transfer to the USA is covered by Standard Contractual Clauses and, where applicable, by OpenAI's adherence to the EU-US Data Privacy Framework.
6. Retention
Alpha application emails: stored until the closed alpha programme ends or until you request deletion, whichever is sooner.
Server logs: 7 to 30 days, then automatically rotated.
License records (code, hashed fingerprint, status): for the duration of your license plus statutory retention periods.
7. Your rights under GDPR
You have the right to:
- Access your personal data (Art. 15 GDPR)
- Correct inaccurate data (Art. 16 GDPR)
- Have your data deleted (Art. 17 GDPR)
- Restrict processing (Art. 18 GDPR)
- Data portability (Art. 20 GDPR)
- Object to processing based on legitimate interest (Art. 21 GDPR)
- Withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal (Art. 7 (3) GDPR)
To exercise any of these rights, email rafael@aidiomusic.ai.
8. Right to lodge a complaint
If you believe that the processing of your personal data infringes the GDPR, you have the right to lodge a complaint with the Austrian Data Protection Authority (Datenschutzbehörde), Barichgasse 40–42, 1030 Vienna, telephone +43 1 52 152‑0, email dsb@dsb.gv.at, web https://www.dsb.gv.at.
9. Changes to this policy
We may update this privacy policy from time to time to reflect changes in our processing or in applicable law. The current version is always available on this page.
Terms of Service / Allgemeine Geschäftsbedingungen (AGB)
Last updated: [FILL IN: date]. These terms govern your use of the AIDIO website and, where applicable, the AIDIO plugin.
1. Parties and scope
These Terms of Service ("Terms") are entered into between you ("User") and the service provider listed in the Impressum ("AIDIO", "we", "us"). They apply to your access to and use of the website aidiomusic.ai and the AIDIO software (plugin and related services).
2. Service description
AIDIO offers an AI assisted audio analysis, mixing and mastering plugin that runs inside Digital Audio Workstations. The plugin connects to a backend proxy operated by us for AI inference and license verification. Functional details are described on this website and in the in-plugin documentation.
3. Subscriptions and pricing
Pricing tiers are shown on the "Pricing" section of the main website. All prices include applicable VAT where shown gross. Subscriptions renew monthly unless cancelled. You may cancel at any time effective from the end of the current billing period.
During the closed alpha period, access is granted free of charge to selected applicants under a separate alpha tester agreement.
4. License grant
Subject to payment of any applicable fees, we grant you a non-exclusive, non-transferable, revocable license to install and use the AIDIO plugin on the number of channels and projects associated with your subscription tier. You may not redistribute, sublicense, reverse-engineer or attempt to circumvent the license enforcement mechanisms of the plugin.
5. Acceptable use
You agree to use AIDIO only in compliance with applicable law. You will not use the service to process audio you do not have the rights to, to generate harmful or illegal content, or in a manner that materially burdens our infrastructure.
6. Disclaimer of warranties
AIDIO is provided "as is" during the alpha and beta phases. We make no warranties that the plugin will meet your specific requirements, will be uninterrupted or error free, or will produce mixing or mastering results suitable for any particular release.
This disclaimer does not affect any mandatory consumer warranty rights you have under Austrian and EU law.
7. Limitation of liability
To the maximum extent permitted by Austrian law, our liability for indirect or consequential damages is excluded. Liability for damages caused by slight negligence is excluded except for personal injury. Liability for gross negligence and intent remains unaffected. Mandatory consumer protection liability under the Consumer Protection Act (KSchG) is not affected.
8. Governing law and jurisdiction
These Terms are governed by Austrian law, excluding its conflict of laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. For consumers ordinarily resident in the EU, mandatory consumer protection rules of the consumer's country of residence remain applicable. Place of jurisdiction for disputes with consumers is the place of residence of the consumer, otherwise [FILL IN: e.g. "Vienna, Austria"].
9. Changes
We may update these Terms with prior notice via email or via a notice on the website. Continued use after the effective date constitutes acceptance.
Right of Withdrawal / Widerrufsbelehrung
For consumers entering into a distance contract under the Austrian Distance and Off-Premises Contracts Act (FAGG), implementing Directive 2011/83/EU.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which the contract is concluded.
To exercise the right of withdrawal, you must inform us (contact details as in the Impressum) by an unequivocal statement (for example a letter sent by post or an email to rafael@aidiomusic.ai) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early performance / loss of withdrawal right for digital content
The right of withdrawal expires early for the supply of digital content not delivered on a tangible medium if performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal (§18 (1) Z 11 FAGG). When activating an AIDIO subscription you will be asked to confirm this acknowledgment before performance begins.
